Disclaimer

Please read this disclaimer carefully before considering purchasing either a model or subscribing to a newsletter.

I, Brent Penfold, do not guarantee in any way that any purchaser or subscriber will realise any trading profits whatsoever or that they will not incur substantial loss.

No presentation is being made that any account will or is likely to achieve profits or losses similar to those shown here. Potential owners or subscribers should carefully consider their suitability to trade the futures contacts and their ability to bear the financial risk.

The entire risk of use and consequences of use of the trading ideas contained in either a model or newsletter fall completely on the purchaser and subscriber and further more I, Brent Penfold, nor anyone else involved in the production of a model or newsletter will be liable for any liability in any respect for any claims, loss, damage or injury alleged to have resulted directly or indirectly from use of or reliance on the trading ideas contained in a model or newsletter.

There is risk of substantial loss in trading futures.

You should be aware of the following matters:

  • You could sustain a total loss of initial margin funds that you deposit with your futures broker to establish or maintain a position in futures.

  • If futures move adversely, you may be required, at short notice, to deposit with your futures broker additional margin funds in order to maintain your futures position.  Those additional funds may be substantial.  If you fail to provide those additional funds within the required time, your position may be liquidated at a loss and in that event you will be liable for any shortfall in your account resulting from that failure.

  • Under certain conditions, it could become difficult or impossible for you to liquidate a position (this can, for example, happen when there is a significant change in prices over a short period).

  • The placing of contingent orders (such as a 'stop-loss' order) may not always limit your losses to the amounts that you may want.  Market conditions may make it impossible to execute such orders.

  • The high degree of leverage that is obtainable in futures trading because of small margin requirements can work against you as well as for you.  The use of leverage can lead to large losses as well as large gains.
